Ask HN: California or Delaware virtual address for Delaware LLC startup?

by QueensGambit on 9/14/21, 8:59 AM with 2 comments

I have a startup registered in Delaware, but we have no physical location (WFH). So, I am planning to get a virtual address from earthclassmail or virtualpostmail. Which state should I pick for virtual address? California or Delaware? Is there tax implication in picking either of these?

You're good, you can use either. A DE LLC formed in DE will be deemed operating in DE, regardless of where you are or where you receive mail. No tax implication for that decision, but obviously there is a tax implication for you personally regarding what state you're living in and where you'll need to pay state income tax, wage tax, whatever else.

Do what your lawyer and accountant recommend.
